Terms of use

Last updated: 2026-10-26

These Terms of Use govern access to and use of the Fanzava platform. They form a binding agreement between you and RYSI Labs Pty Ltd, trading as Fanzava. Please read them carefully.

1. About These Terms and About Fanzava

1.1 Who we are. Fanzava is a trading name of RYSI Labs Pty Ltd (ABN 99 692 790 435, ACN 692 790 435, “Fanzava”, “we”, “us”), the developer and operator of the Fanzava platform (the “Platform”). The Platform is competition-management software that allows organisations and individuals (each a “Hub Admin”) to host audience-engagement competitions such as tipping ladders, brackets, and prediction games. Our registered office is at 228A St Vincent Street, Port Adelaide SA 5015, South Australia, Australia.

1.2 Who these Terms apply to. These Terms apply to everyone who accesses the Platform through any interface Fanzava provides, including any web or mobile application, and including:

  • Participants (also called “Tippers”) who join competitions hosted by a Hub Admin;
  • Hub Admins who configure and operate competitions on the Platform; and
  • Visitors who browse public Hub pages without registering an account.

Participants accept these Terms when they create an account.

1.3 Other documents that may apply. The Fanzava Privacy Policy explains how we collect, use, share, and retain personal information. The Fanzava Acceptable Use Policy governs how you may use the Platform, and the Fanzava Refund and Cancellation Policy governs subscription cancellations and refunds; both are incorporated into these Terms by reference. The Free Hub Admin Agreement applies in addition to these Terms for any Hub Admin operating a Hub on the Free plan. A Master Service Agreement (MSA) applies for Enterprise Hub Admins; where the MSA conflicts with these Terms for that customer, the MSA prevails, except as stated in section 9.2. Self-serve paid plans (Starter, Growth, Pro, and Scale) are governed by these Terms, the Refund and Cancellation Policy, and the plan features, limits and price shown at the time of purchase. Where a Hub Admin publishes Hub Competition Terms, those terms, and on paid plans the Hub’s own Hub Privacy Notice, are between you and the Hub Admin, not between you and Fanzava. On Free Hubs, the Fanzava Privacy Policy is the privacy notice.

1.4 Fanzava is not a betting or gambling platform. Fanzava does not facilitate, process, or permit wagering of any kind. Competitions hosted on the Platform are intended as audience-engagement experiences, not gambling products. Hub Admins are responsible for ensuring their competitions do not constitute gambling, lottery, or wagering activity in any jurisdiction where they are offered.

2. The Platform’s Role and How Responsibility Is Allocated

2.1 Fanzava as a software provider. Fanzava develops and operates the Platform. We provide the technology that allows Hub Admins to run competitions; we are not the organiser, promoter, or sponsor of any specific competition unless we expressly say so in writing.

2.2 Hub Admins as the legal Promoter. The Hub Admin is the legal Promoter of any competition they create on the Platform. As Promoter, the Hub Admin is solely responsible for:

  • compliance with all applicable laws, including consumer-protection, privacy, trade-promotion, and lottery regulations in every jurisdiction where their competition is offered;
  • obtaining any regulatory permits, licences, or approvals required to run the competition;
  • the procurement, funding, guarantee, and distribution of any prizes;
  • providing accurate Hub Competition Terms to participants and, on paid plans, a Hub Privacy Notice; and
  • resolving participant disputes about competition rules, scoring interpretations, or prize fulfilment.

2.2A Hub Competition Terms. Fanzava provides a starter template for Hub Competition Terms. Whether a competition needs terms, and what they contain, is the Hub Admin’s responsibility under section 2.2. Any terms a Hub Admin publishes must not conflict with these Terms or the Acceptable Use Policy, or describe Fanzava as the promoter of the competition.

2.3 Allocation varies by plan. The allocation in section 2.2 is a default. It applies most strongly where the Hub Admin operates on any paid plan (Starter, Growth, Pro, or Scale) or Enterprise, uses a custom domain, removes the Fanzava watermark, and presents the competition under their own branding.

For Hubs on the Free plan, where the Hub is hosted on a Fanzava sub-domain (such as yourhub.fanzava.com), displays the Fanzava watermark, and may include Fanzava advertising surfaces, Fanzava retains a more visible role as host. While the Hub Admin remains the legal Promoter, Fanzava acknowledges that: a Free Hub is hosted on Fanzava’s branded property; Fanzava actively moderates content on Free Hubs (see section 4); Fanzava restricts the categories of competition that may run on a Free Hub (no prizes, deterministic skill-only scoring, no public marketing or CRM-enabled campaigns, see the Free Hub Admin Agreement); and participants on Free Hubs have a direct support relationship with Fanzava for Platform-related issues. This dual posture is intentional. It allows Fanzava to provide a low-friction product entry point without overstating the legal distance between the Platform and a Free Hub.

2.4 Fanzava does not guarantee prizes. Fanzava does not offer, fund, guarantee, or accept liability for the fulfilment of prizes on any Hub. Disputes regarding prize fulfilment must be resolved with the Hub Admin. For clarity, Hubs on the Free plan are not permitted to offer prizes (see the Free Hub Admin Agreement).

3. Eligibility, Age, and Account Registration

3.1 Minimum age to use the Platform. You must be at least 13 years of age to create an account on the Platform. If you are under the age of majority in your jurisdiction (typically 18), you may only use Fanzava with the consent and supervision of a parent or legal guardian. Fanzava does not knowingly collect personal information from anyone under 13.

3.2 Hub-specific age requirements. The Platform’s minimum age is 13. A Hub Admin may set a higher minimum age for their Hub.

3.3 Age confirmation. Fanzava provides an age-confirmation step at signup set to the Hub’s minimum age. Fanzava does not retain dates of birth and does not verify identity documents. It is the Hub Admin’s responsibility to enforce stated age restrictions, including verifying winner eligibility off-platform before any prize is distributed. Fanzava accepts no liability for age-ineligible users entering a Hub competition.

3.4 Account accuracy and security. You must provide accurate registration information and keep your account credentials confidential. You are responsible for activity on your account. Each account belongs to a single Hub. If you join more than one Hub, you hold a separate account in each, with its own credentials and settings. If you become aware of unauthorised access to your account, contact us at security@fanzava.com.

3.5 Cookies and similar technologies. The Platform uses essential cookies and similar local-storage technologies to authenticate you, maintain your session, and operate basic platform functions; these are required for the Platform to work. Analytics and advertising technologies are used as described in section 10 of the Privacy Policy, including when consent is required and how to change your choice.

4. Acceptable Use and Content Moderation

4.1 User-generated content. The Platform includes social features such as the Banter Board, leaderboard nicknames, and public Hub display names. You are responsible for the content you contribute. By contributing content, you grant Fanzava and the relevant Hub Admin a non-exclusive, worldwide, royalty-free licence to display, store, distribute, modify, and remove that content for the purpose of operating the Platform and the Hub.

4.2 Acceptable use. Your use of the Platform, and all content you contribute, is subject to the Fanzava Acceptable Use Policy, which is incorporated into these Terms by reference and sets out prohibited content and conduct in full. Fanzava may update the Acceptable Use Policy as described in that policy.

4.3 Moderation, by plan. Fanzava and Hub Admins reserve the right to moderate, flag, suppress, and remove content. On every plan, Fanzava applies automated controls to user content: posts containing profanity, personal contact details or prohibited links are rejected; content flagged by multiple users is hidden automatically; and accounts are restricted automatically after repeated warnings. Suspensions and bans, including automatic ones, can be appealed. Moderation arrangements differ by plan:

(a) Paid Hubs (Starter, Growth, Pro, Scale, and Enterprise). Primary moderation is the Hub Admin’s responsibility. Fanzava monitors at the platform level and intervenes in cases of severe abuse, illegal content, or conduct that spans more than one Hub (for example, the same person repeating abuse across Hubs, or joining another Hub to evade a ban).

(b) Free Hubs. Because Free Hubs are hosted on Fanzava-branded URLs, Fanzava actively moderates content alongside the Hub Admin. Fanzava may remove content without prior notice to the Hub Admin, and, in serious or repeated cases, suspend or terminate the Free Hub.

4.4 Enforcement. Enforcement follows the Acceptable Use Policy. In summary, Banter Board violations operate on a warning system that leads to an automatic suspension after repeated warnings, and for severe abuse, repeat cross-Hub offences, or illegal content, Fanzava’s Global Administrators may remove a participant from a Hub or impose a platform-wide ban.

4.5 Reporting. If you encounter content you believe violates these Terms, you may report it within the Platform or by emailing trust@fanzava.com.

5. Intellectual Property

5.1 Fanzava’s Platform IP. Fanzava retains all rights, title, and interest in the Platform, including its software, source code, architecture, scoring engine, algorithms, designs, and interfaces. Use of the Platform does not grant you any ownership in Fanzava’s intellectual property.

5.2 Hub Admin branding and content. Hub Admins retain ownership of the brand assets they upload to the Platform, including logos, brand colours, typography, custom web domains, and custom email sender domains, and grant Fanzava a limited, non-exclusive, royalty-free licence to display, distribute, and process these assets solely to operate the Hub as configured.

5.3 Participant content. Participants retain ownership of the content they post on the Platform. The licence granted under section 4.1 is the only licence Fanzava and Hub Admins claim to that content. The licence terminates when the content is deleted, subject to legitimate legal-hold or backup-retention requirements described in the Privacy Policy.

5.4 Fanzava branding on Free Hubs. Hubs on the Free plan display the Fanzava watermark and a “Powered by Fanzava” link. These elements are part of the Free plan offering, are not modifiable, and may be removed by upgrading to a paid plan.

6. Service, Sports Data, and Limitation of Liability

6.1 Service availability. Fanzava operates a serverless cloud architecture and aims for high availability. The Platform is provided on an “as is” and “as available” basis. A specific uptime commitment and service-level agreement is available only on the Enterprise plan and is set out in the Master Service Agreement and the applicable Order Form. Fanzava does not commit to any specific uptime on other plans, including Free Hubs.

6.2 Service changes. We may modify, suspend, or discontinue features at any time. We will give reasonable notice of changes that materially reduce functionality on paid plans. Changes affecting Free Hubs may be made without advance notice.

6.3 Sports data. Fanzava uses third-party sports-data providers for fixtures, lockouts, and results. We do not warrant the accuracy, completeness, timeliness, or uninterrupted availability of third-party sports data. Where we become aware of an error in fixtures, lockout times or results, we will use reasonable endeavours to correct it promptly, including by manual override under section 6.4. Hub Admins should communicate this to their participants.

6.4 Result corrections. Fanzava’s Global Administrators have the exclusive right to issue manual result overrides where third-party data is erroneous or has been corrected by the source. Hub Admins cannot override match results. Where an override changes leaderboards or affects prize allocation, Fanzava will notify the Hub Admin; the Hub Admin remains responsible for any consequential prize-fulfilment decisions.

6.5 Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or equivalent legislation in your jurisdiction that cannot lawfully be excluded.

6.6 Limitation of liability. To the maximum extent permitted by law, and subject to section 6.5:

(a) Fanzava is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, business, or goodwill, however caused; and

(b) Subject to paragraphs (c) and (d), Fanzava’s aggregate liability for any claim arising from or relating to these Terms or your use of the Platform is limited to the total amount paid by you to Fanzava for the Platform during the twelve (12) months preceding the event giving rise to the claim.

(c) For liability arising from a personal-data breach caused by Fanzava’s breach of its security or data-protection obligations, or from a breach of confidentiality, the limit in paragraph (b) is two times (2x) that amount. Where a Data Processing Agreement is in place between you and Fanzava, that agreement governs the limitation of liability for the processing of personal data.

(d) Nothing in this section limits Fanzava’s liability for fraud, for death or personal injury caused by negligence, or any other liability that cannot be limited or excluded under applicable law (see also section 6.5).

6.7 Hub Admin indemnity. Hub Admins indemnify Fanzava against any third-party claim to the extent arising out of (a) the Hub Admin’s competition design, prize fulfilment, or marketing; (b) the Hub Admin’s breach of applicable law including trade-promotion or privacy law; or (c) content the Hub Admin or its participants publish on the Hub. This indemnity is conditional on Fanzava notifying the Hub Admin promptly of any relevant claim and not settling without the Hub Admin’s prior written consent (such consent not to be unreasonably withheld).

7. Suspension and Termination

7.1 Your right to terminate. You may close your account at any time through your account settings. Closing an account closes it in that Hub only. Account closure is processed in accordance with the deletion workflow in the Privacy Policy.

7.2 Fanzava’s right to suspend or terminate. We may suspend or terminate your account, or a Hub, where: you materially breach these Terms or another applicable agreement; we are required to do so by law or by a binding order of a competent authority; your use creates a security or integrity risk to the Platform or to other users; or we reasonably believe you have engaged in fraud, abuse, or serious or repeated content violations. For Free Hubs, which are hosted on Fanzava-branded URLs, we may also act where the Hub creates a material risk to Fanzava’s reputation or brand.

For paid Hubs, where the ground for suspension or termination is a breach that can be remedied and does not involve a serious risk, we will give you written notice and at least 14 days to remedy the breach before acting. We may act immediately and without prior notice where reasonably necessary to address a security or platform-integrity risk, suspected fraud, illegal content, or to comply with law or a binding order.

7.3 Effect of termination. On termination, your right to access the Platform ends. Provisions intended to survive termination, including IP rights, indemnities, limitation of liability, and governing law, remain in force.

8. Changes to These Terms

We may update these Terms from time to time. For material changes, we will notify registered users by email and post a change summary on the Platform at least 14 days before the change takes effect. Continued use of the Platform after the effective date constitutes acceptance. If a change materially reduces the functionality of a paid plan or materially and adversely affects your rights, and you do not accept it, you may cancel your subscription by written notice before the change takes effect and receive a pro-rata refund of prepaid fees for the unused portion of your current term.

9. Governing Law and Dispute Resolution

9.1 Governing law. These Terms are governed by the laws of South Australia, Australia.

9.2 Jurisdiction. The courts of South Australia have exclusive jurisdiction to determine any dispute arising under or in connection with these Terms. This applies to all users of the Platform, including Enterprise customers; a Master Service Agreement does not override this section. The only exception is that Fanzava may bring proceedings in any court that has jurisdiction to seek injunctive relief or to enforce its intellectual property rights.

9.3 Consumer rights preserved. Nothing in this section limits any non-excludable right you have to pursue claims in your local jurisdiction under applicable consumer-protection law.
